According to a recently published database on foreign courts’ judgements and foreign arbitral awards in Vietnam from 2012 to 2019, only 49% of said judgements and awards were recognised and enforced by the Vietnamese Court. To equip the readers with a better comprehension of the legal intricacies behind the incredibly low rate of acceptance, my insight explores and explains in depth the reasons for the Vietnamese Court’s non-recognition, the legislative differences between the jurisdictions, the effect international treaties have on the matter, as well as the significance the said statistic bears on a nation and its jurisdictional independence.
