On 5 September 2013, the Government introduced Decree 102 which provides more specific regulations on the implementation of various articles under the new Labor code on foreign employee management. Decree 102 will take effect from 1 November 2013.Decree 102 introduces various changes. For example, employers must submit a report of the demand for foreign employees on an annual basis to the local People’s Committee where the company’s head office is located. On the other hand, the new Decree extends the categories of foreigners working in Vietnam, including technicians, volunteers and persons responsible for establishment of a commercial presence.
Employers of foreign nationals who require authority to work in Vietnam should review these changes to ensure their employee population is compliant, and implement the requirements to minimise unexpected impacts to the business.
