Alert on immigration - Resolution 105 expires and its effects on work permit procedures for foreign labour
Resolution No.105/NQ-CP was issued on 9 September 2021, in the context of the Covid-19 pandemic. As part of the Resolution, some notable solutions were proposed easing regulations on the issuance, extension and certification of work permit for foreign labour in Vietnam as well as the mobility of foreign labour having valid work permit nationwide. However, the Resolution expired at the end of 31 December 2022 and the regulations on work permit for foreign labour now revert back to the stricter standards as mandated in the Decree 152/2020/ND-CP dated 30 December 2020 until further notice.
Such expiration, together with certain additional administrative requirements on job posting, personnel plan etc. recently required, are likely to affect the work permit application procedure and the mobility plans of the businesses using foreign labour.
