Calling for Comments on Draft Decree on Enterprise Registration

Dear Members and Friends,

In order to provide better guidance on a number of regulations of the Enterprise Law 2020 and remove bottlenecks during the implementation of Decree No. 01/2021/ND-CP, the MPI recently has issued the Draft Decree on enterprise registration for public comments.

Some key contents of the Draft are as follows:

  • Removing regulations on business household registration and regulate a system of forms applicable to enterprise registration;
  • Supplementing regulations on the use of personal identification numbers when carrying out enterprise registration procedures;
  • Clarifying the dossier component "resolution or decision";
  • Supplementing regulations on the legal status of branches, representative offices, and business locations of the enterprises;
  • Guidance to the Clause 4, Article 215 of the Law on Enterprises;
  • Adding regulations amending Decree No. 31/2021/ND-CP dated March 26, 2021 guiding the Law on Investment;
  • Remove regulations on business registration for credit institutions;
  • Business registration regulations for branches, representative offices, and business locations of securities companies.
